The bail application of a guy accused of sending his girlfriend's private photos to her family was denied by the Allahabad High Court.
The court stated that this is an exclusive case of the applicant Balram Jaiswal betraying the girl's faith and describing him as the "most gender insensitive and crooked man."
In his ruling dated February 7, Justice Rahul Chaturvedi, in rejecting his application, stated, "After reviewing the evidence, it is clear that the applicant is not deserving of sympathy. Given that it was the applicant who exploited his relationship for his own pleasure, he gained the victim's trust, obtained those intimate photographs, and then began blackmailing her. He is the most insensitive and crooked guy I've ever met."
The girl and Jaiswal, both in their early twenties, met on the Facebook network. When their connection grew stronger, they travelled to a variety of locations. Jaiswal is said to have offended her modesty.
Following that, he allegedly grabbed private "videos and images" of her and began using her. Jaiswal is also accused of intercepting her on her way home on February 22, 2021, misbehaving with her and threatening her with various threats and filthy abuses.
The girl then filed a complaint with the Lanka police station in Varanasi district under section 376 (rape) and other parts of the Indian Penal Code, as well as section 67 of the Information Technology Act. In connection with this matter, Jaiswal has been detained since August 9, 2021.
"All these materials clearly indicates the selfish and short-sighted mentality of applicant, who would cruelly sacrifice other's dignity, honour on the road who was his own girlfriend at one point in time in order to establish the consensual connection," the court said in its judgement.
"Obviously, the victim will have to pay a high price in the future. In these situations, the applicant cannot be allowed to roam freely without paying the consequence for his or her transgression. In a word, this is a one-of-a-kind case of the applicant betraying the victim's faith. In her court statement, she indicates unequivocally that the applicant shared those private images to her family members."
