The Texas Supreme Court has given the green light to a new state law that bans gender-affirming care for minors, making Texas the most populous state in the U.S. to impose such restrictions on transgender children. The American Civil Liberties Union (ACLU) and other legal advocates who had sued on behalf of affected families and doctors condemned the law and the Texas Supreme Court's decision. They released a joint statement asserting that transgender youth and their families now face uncertainty and fear as the school year begins. However, they also emphasized that the battle is far from over, hinting at continued legal challenges.

The controversial law had faced opposition from the start. A state district judge had ruled it unconstitutional, stating that it violated the rights of transgender children and their families to seek appropriate medical care. Moreover, the judge argued that it interfered with doctors' ability to adhere to well-established, evidence-based medical guidelines without risking their medical licenses.

Following this ruling, a temporary injunction was issued to block the law's implementation. State officials swiftly appealed the decision to the Texas Supreme Court, setting the stage for the recent ruling.

Implications of the law

The Texas law prohibits transgender minors from accessing hormone therapies, puberty blockers, and transition surgeries, despite medical experts' assertions that such surgical procedures are rarely performed on children. Additionally, the law mandates that children who had already commenced the banned medications must be gradually weaned off them through a "medically appropriate" process.

Controversial impact and concerns

While supporters of the law, like the conservative group Texas Values, argue that it safeguards children from "harmful and dangerous gender transition surgeries and puberty blockers," opponents warn of dire consequences for transgender teens. Physicians who treat transgender children express concerns that denying them safe and effective treatment may lead to deteriorating mental health and, potentially, suicide.

The Texas ban on gender-affirming care for minors became law in June after being signed by Republican Governor Greg Abbott. Governor Abbott had made headlines earlier for being the first governor to order investigations into families of transgender minors receiving gender-affirming care.
