In a recent decision, the Supreme Court of India reversed a previous ruling by a trial court that directed Bloomberg, an international media group, to remove a news article deemed defamatory towards Zee Entertainment. Bloomberg had appealed against the trial court's decision, which was upheld by the Delhi High Court on March 14.
The three-judge bench, led by Chief Justice D Y Chandrachud, highlighted that both the trial court and the high court had failed to adequately consider the matter. They noted that simply acknowledging the existence of a prima facie case and expressing concerns about potential harm to Zee Entertainment did not demonstrate a proper application of legal principles. The bench granted Zee Entertainment the option to pursue its injunction request anew in the trial court.

Following the Supreme Court's ruling, Bloomberg expressed optimism, affirming their commitment to the article in question. The legal dispute arose when Zee Entertainment filed a lawsuit over a Bloomberg article published on February 21, alleging defamation. The trial court initially sided with Zee Entertainment, ordering Bloomberg to remove the article within a week. However, Bloomberg argued that the lawsuit was an attempt to stifle freedom of speech and was not afforded a fair opportunity to present its case.
