Punjab & Haryana HC quashes FIR against actor, cites 'Every God Was Born Human'

The Punjab and Haryana High Court has quashed criminal proceedings against Punjabi actor Rana Jung Bahdur, who was accused of hurting religious sentiments. The actor was booked by Jalandhar police on June 10, 2022, for allegedly making objectionable remarks about Maharshi Valmiki during a TV show. The case was filed under Section 295-A of the Indian Penal Code (IPC) and the SC/ST Act, which led to protests from the Valmiki community in Jalandhar.

Court's observations

The High Court, while dismissing the FIR, made significant observations. Justice Pankaj Jain noted that the transformation story of Maharshi Valmiki is well-known in Indian folklore and scriptures, even if it may not be agreeable to everyone. The court stated that all worshiped Gods, regardless of religion, were born as humans. It further highlighted that these individuals attained divinity due to their contributions to society and the strength of their character. Over time, people began to worship them, inspired by their journey from "nar to narayan" (human to divine), a concept rooted in Indian culture and applicable to religions beyond India.

FIR quashed

The court emphasized that the actor's remarks referred to a well-known aspect of Maharshi Valmiki's early life. It did not wish to delve into the accuracy of these facts but underscored that the complaint was based on this reference. The court concluded that the FIR and related proceedings lacked sufficient grounds, leading to their quashing.

This ruling underscores the importance of understanding the context and intent behind remarks, especially those rooted in historical and religious narratives, while also protecting individuals from unwarranted legal action.
