Vinesh Phogat awaits CAS ruling after Paris Olympics disqualification: understanding the Court of Arbitration for Sport

Vinesh Phogat was in excellent form as she advanced to the women's 50kg final at the Paris Olympics 2024. However, she was disqualified for being 100 grams overweight. Earlier, Phogat made history as the first Indian woman wrestler to qualify for an Olympic final.

Despite her disqualification, Phogat has appealed to the Court of Arbitration for Sport (CAS) for the chance to compete for gold. She has requested to be awarded a joint silver medal if she is allowed to fight. The interim ruling from CAS is expected on Thursday.

Understanding CAS

The CAS, established in 1984, is an international body that settles sports disputes through arbitration. Its headquarters are in Switzerland, with courts in New York, Sydney, and Lausanne, and temporary courts in Olympic host cities. John Coates has been the CAS president since 2011.

Disputes can only be submitted to CAS if an arbitration agreement specifies recourse to the CAS. All Olympic games disputes must be submitted to CAS, and all Olympic international federations recognize its jurisdiction in some disputes.

The CAS was originally created by IOC president Juan Antonio Samaranch to handle Olympic disputes. It became part of the IOC in 1984. Under the 2009 World Anti-Doping Code, all signatories, including Olympic international federations and national Olympic committees, agree to CAS jurisdiction for anti-doping violations. Since 2016, a division of CAS judges specializing in doping cases has replaced the IOC disciplinary commission. CAS decisions can be appealed to the Federal Supreme Court of Switzerland.
